Once you have registered on this site, you may use our images free of charge for any [non-commercial] use to promote [your business/tourism venture] in Thanet subject to the following terms and conditions of use.
1. Use of Images
a) Once you have registered on this website, you may use our images free of charge for [non-commercial] use to promote Tourism in [Kent/Thanet etc]. You are not entitled or authorised to sell, re-sell, use, broadcast, post or reproduce images for any commercial use, or for any non-tourism related purpose, unless you have entered into a separate licence agreement with Thanet District Council and paid the appropriate fee. If you are unsure as to what constitutes a commercial and/or a non-commercial use, please contact us [8].
b) You must satisfy yourself that all permissions, rights, and consents that may be required for non-commercial reproduction of the images (both print and digital) have been obtained from all appropriate parties.
c) The following terms and conditions apply to the use, reproduction and/or publication of images:
i) You must formally credit Images that you use as having come from: (i) Thanet District Council/@VisitThanet and (ii) any other person(s) stipulated at the point of download.
ii) Images must not be altered, manipulated, added to or have any part deleted without our prior written consent.
iii) You must provide us with at least one complimentary copy of, or link to, any publication or reproduction in which the image(s) appears.
iv) You may not use or reproduce any images from this website for any negative tourism related purposes. Whether any such use is deemed to be negative is at the absolute discretion of Thanet District Council and if you are unsure about this issue, then please contact us [8]. Furthermore, you shall not use or reproduce any image in any way that could bring Thanet District Council or Visit Thanet into disrepute.
d) All Thanet District Council and Visit Thanet rights (including copyright, trade marks and other intellectual property rights) in the Photo Library are reserved by Thanet District Council as owner or on behalf of licensors as licensee, as appropriate and nothing in this licence operates to transfer or licence these rights or any of them to you.
e) You will not claim nor imply that you have an exclusive relationship with Thanet District Council or Visit Thanet or that either body specifically endorses your [business/tourism venture]
2. Failure to comply
In the event that you breach and/or fail to comply with any of the above terms and conditions, we may cancel your registration forthwith and withdraw your right to use the website and the images you may have downloaded and your licence will terminate with immediate effect.
3. Damages
Where you are in breach of these terms we also reserve the right to seek as liquidated damages a sum equal to three times the market value charged under normal stock photography rates (as calculated by Thanet District Council, acting reasonably). If you fail to make this payment within 5 working days of us invoicing you for such a fee, we reserve the right to institute proceedings against you for copyright infringement or as otherwise deemed appropriate, and to seek to recover from you all related legal fees and associated costs
4. Warranties
a) Thanet District Council/Visit Thanet images are provided hereunder on a free of charge, non-exclusive, ‘as-is’ basis . To the fullest extent permitted by law, Thanet District Council excludes all representations and warranties (whether express or implied by law) including warranties as to satisfactory quality, fitness for a particular purpose, security and accuracy. Furthermore, it excludes all liability to you for any loss or damage (direct or indirect) howsoever arising out of or in connection with your use of this library service.
b) Thanet District Council does not warrant that this photo library service will be uninterrupted or error free, or free of viruses or bugs.
5. Indemnity
You agree to indemnify Thanet District Council/Visit Thanet in respect of all damages, costs, claims, demands, liabilities, losses, costs and claims arising out of or as a result of your breach of these licence terms and conditions or otherwise in connection with your use of the photo library.
6. Termination
Thanet District Council may terminate this photo library service at its sole discretion without cause at any time with immediate effect.
7. Applicable law
This licence will be governed by the laws of England and Wales and both parties submit to the exclusive jurisdiction of the courts of England and Wales in the event of any claim or dispute in connection with your use of the photo library and/or these terms and conditions
